Terms of Service

These terms set out the conditions for using the iOS app Kururec (“the app”) and this website (together, “the service”), provided by TenStella (“we”). By downloading or using the app, you are deemed to have agreed to these terms.

1. Conditions of use

You may use the app only if you comply with these terms and with applicable law. Downloading the app and transacting through the App Store are also subject to Apple's terms of service. The software license for the app is Apple's Licensed Application End User License Agreement (the standard EULA). Where any part of these terms concerning the license to the app conflicts with that EULA, the EULA prevails and these terms apply as a supplement to it.

2. Pricing and subscriptions

• The app is free to use. The paid plan Kururec Pro is an auto-renewing subscription, available as a monthly or an annual plan. On the U.S. App Store the price is US$0.99 per month or US$6.99 per year; in Japan it is ¥200 per month or ¥1,200 per year. Prices vary by region (storefront) and are shown in the App Store before you purchase.
• All payments are processed through Apple (the App Store). The subscription renews automatically unless it is canceled at least 24 hours before the end of the current period.
• You can cancel on your iPhone under Settings → your name → Subscriptions.
• Refunds follow Apple's rules. Except where required by law, we are generally unable to provide refunds.
• If we change prices, we will announce it in advance on this page or in the app.

3. Important disclaimer regarding recording

The app turns a smartphone into a temporary dashcam. It is not warranted to be a complete replacement for dedicated dashcam hardware.

• We do not warrant that recording will be continuous or complete. Recording may stop, drop footage, or produce corrupted files because of how iOS works (moving to the background, incoming calls, and so on), the device's overheat protection, insufficient storage, or defects in the app or the OS.
• We do not warrant that footage will be admissible as evidence. We make no warranty that recorded footage can be used as evidence in an accident or any other situation.
• Where reliable recording matters — commercial use, for example — we recommend running dedicated dashcam hardware alongside the app.

4. Your responsibilities

• Safe driving: Do not operate the app while driving. Start recording and change your settings before you set off.
• Mounting: Mount the device in a position and manner that complies with the vehicle equipment regulations and other laws applicable where you drive, and that does not obstruct your view of the road. (In Japan, this means the safety standards under the Road Transport Vehicle Act; suction mounts on the windshield are also restricted in some countries and in some U.S. states.)
• Lawfulness of recording: It is your responsibility to confirm that recording video, and audio if you enable the microphone, is lawful under the law of the place where you use the app and with respect to the privacy and publicity rights of others.
• Managing your data: Saving and backing up the footage you need is your responsibility.

5. Prohibited conduct

• Conduct that violates law, public order, or morals
• Reverse engineering, decompiling, or disassembling the app (except where permitted by law)
• Interfering with the operation of the service, or unauthorized access to our systems
• Infringing our intellectual property or other rights, or those of third parties

6. Intellectual property

Intellectual property rights in the service belong to us or to their rightful owners. Rights in the footage you record belong to you (we never obtain your footage).

7. Disclaimer and limitation of liability

The app is provided as is, and we make no warranty, express or implied, including as to fitness for a particular purpose. We are not liable for damage arising to you in connection with your use of the service, except where we have acted with intent or gross negligence. Even where we are liable, our liability is capped at the amount you have paid us in respect of the app over the preceding 12 months. Nothing in this section excludes the application of Japan's Consumer Contract Act or any other mandatory provision of law.

8. Changes to these terms

We may change these terms as necessary. If a change is significant, we will announce it on this page. If you continue to use the service after a change, you are deemed to have agreed to the revised terms.

9. Governing law and jurisdiction

These terms are governed by the law of Japan. In the event of a dispute concerning the service, the district court having jurisdiction over our place of business shall be the exclusive court of first instance by agreement.
